For those readers who may be unfamiliar with Brownstone, it is a non-partisan think tank dedicated to “elevating learning, science, progress, and universal rights to the forefront of public life”, as noted on their elaborate and informative website.</em></p>

<p>New York State&#8217;s <a href="https://www.nycvotes.org/whats-on-the-ballot/2024-state-and-federal-general-election/2024-ballot-proposals/ballot-proposal-1/" target="_blank" rel="nofollow noopener noskim">Ballot Proposal 1</a> is a &#8220;bait and switch,&#8221; says Bobbie Anne Cox, a New York civil rights attorney and a Fellow at the Brownstone Institute.</p>
<p>&#8220;You know, the language sounds wonderful when you read it on the ballot. … It sounds great, prevent unequal treatment to these classes. And then it lists like 12 new classes that they want to add to our Constitution in New York State,&#8221; Cox said Monday during an appearance on <a href="http://www.newsmax.com/live" target="_self" rel="noopener">Newsmax</a><a href="https://www.newsmax.com/live" target="_self" rel="noopener">&#8216;s</a> &#8220;<a href="https://www.newsmaxtv.com/Shows/The-Chris-Salcedo-Show" target="_self" rel="nofollow noskim noopener">Chris Salcedo Show</a>.&#8221;</p>
<p>&#8220;But when you read the actual language that would go into our Constitution and not just the two sentence summary that&#8217;s on the ballot, you understand that this is a lot more than what they&#8217;re saying. This is they named it something lovely, like the Equal Rights Amendment. But that language doesn&#8217;t even appear on the ballot. It&#8217;s not part of the proposal that would go into the Constitution,&#8221; she added.</p>
<p>Ballot Proposal 1, according to NYC Votes, an initiative of the New York City Campaign Finance Board, &#8220;adds anti-discrimination provisions to State Constitution. Covers ethnicity, national origin, age, disability, and sex, including sexual orientation, gender identity, and pregnancy. Also covers reproductive healthcare and autonomy.&#8221;</p>
<p>Cox said the measure will, if passed, &#8220;erode parental rights.&#8221;</p>
<p>&#8220;It&#8217;s going to give males a constitutional right to be in female spaces, locker rooms, bathrooms, showers, dormitories. It&#8217;s going to give illegal immigrants the same rights as citizens. And it&#8217;s going to make New York State a permanent sanctuary state.</p>
<p>&#8220;It&#8217;s going to open the door for noncitizen voting, and you&#8217;re also going to see the disintegration of parental rights because, you know, it says you can&#8217;t discriminate based on age. You&#8217;re going to have parents being pushed out of their children&#8217;s lives and decisions, which is already happening here in New York State, as we saw with this guidance that the New York State Department of Education issued last year, which says that schools have to refrain from telling parents when their child is interested in or is actually trying to change their gender.&#8221;</p>
<p>New York City two years ago &#8220;passed a law saying that noncitizens could vote in their elections,&#8221; she added.</p>
<p>&#8220;And if you read the language, it would include some illegal immigrants as well. Now that was challenged, and it was struck down by the court. But Mayor [Eric] Adams is appealing and is trying to get that law reinstated. So, you know, we&#8217;re already seeing these things happen. And if Prop. 1 passes and this goes into our Constitution, the floodgates are going to open. And all of this is going to become fair game.&#8221;</p>

										<content:encoded><![CDATA[<p style="padding-left: 40px;">Attorney Bobbie Anne Cox, and Wai Wah Chin from the Chinese American Citizens Alliance Greater New York sounded the alarm on <a href="https://rumble.com/v5dnja5-prop-1-era-otherwise-known-as-the-parent-replacement-act-discussion..html">Good Morning CHD with host Michael Kane</a> about the extreme dangers of Prop 1.  On November 5, 2024, Prop 1 will be on the ballot for New Yorkers to vote on. It is crucial that every NY voter understands the consequences of Prop 1 before they vote.</p>
<p style="padding-left: 40px;"><a href="https://rumble.com/v5dnja5-prop-1-era-otherwise-known-as-the-parent-replacement-act-discussion..html">In the interview,</a> Attorney Cox and Wai Wah give details on what this amendment would do to parental rights, children, women/girls’ sports, how it will allow illegals rights as citizens and more.  Attorney Cox explains that the <em>“Democrats have a very weak argument”.  She says “it is a form of gaslighting”</em> when they claim the proposal is all about protecting women’s rights to abortion.  According to Attorney Cox, <em>“the word abortion is not in the amendment.” </em> She said, <em>“if it was about abortion why didn’t they add it to the language of the amendment?”  </em>She also points out that NY already has very strong laws (for about 50 years) that protect women’s rights to abortion. Attorney Cox said putting abortion in the state constitution is completely unnecessary because the laws are set and there is no chance the abortion laws will be reversed. “<em>It is a smokescreen and not the true reason they are pushing this amendment. What Democrats are really doing will cause a reversal of women’s rights.”</em></p>
<p style="padding-left: 40px;">If Prop 1 passes, both Attorney Cox and Wai Wah claim the result will be a total breakdown of the family which is one of the goals of the Democrats in NYS.  It is so important that every New Yorker educates themselves about Prop 1. <p>You know what’s crazier than a NY Department of Health? The Appeals Court judges who ruled that NY lawmakers “don’t have standing” to argue their Constitutional right to make and pass the laws of NY state. Once the rule of law is seen to be capricious and arbitrary, why bother living lawfully?</p>

<p>Three legs make a stool stable.  Once upon a time, the US had significant economic and social stability because of  (1) the legislative branch, (2) the executive branch, and (3) the judicial branch.</p>
<p>Laws aren’t tangible things; they are words on paper that people imbue with power because they are fair and widely agreed upon.</p>
<p>These days, it’s remarkably easy to find jaw-dropping court decisions that don’t even pretend to follow the laws of the land.  They are often indistinguishable from virtue-signaling ‘in-group’ expressions so that the judges and prosecutors involved can advance their partisan power or increase their local social standing.</p>
<p>Today’s Off The Cuff podcast with attorney Bobbie Anne Cox starkly illustrates one such case.  After whomping the NY Governor and Attorney General in a trial court, Bobbie Anne saw her case not only get appealed but overturned on appeal 5-0.</p>
<p>The case?  Challenging the nefarious and deeply concerning laws that the NY Department of Health had passed that gave them the right to quarantine anyone at any time for any length of time in any facility of their choosing (including one’s own home) without having to prove that the involved persons actually had an illness or any communicable disease at all.</p>
<p>The case rested on the Constitutional principle that only lawmakers have the power to pass laws, and that agencies are limited to interpreting those laws.  The actions of the NY Health Department wildly exceeded their authority by making rules that were really laws in that they deprived people of their freedom and ability to earn income without any due process remedy available.</p>
<p>The appeals court made the jaw-dropping, <em>comical-if-it-weren’t-so-serious</em>, “ruling” that the three NY lawmakers Ms. Cox had as plaintiffs “didn’t have standing” to bring the case and struck down the trial court decision.   Well, if lawmakers don’t have standing in a case involving the making of laws, then the laws don’t actually mean anything.  They are empty words on paper.</p>
