<p class="has-drop-cap">e are in the deep throes of a constitutional crisis in the following sense: we are trying to find our way back to it.</p>
<p>In a likely never before seen openly brazen way, we have not two, but all <em>three</em> branches of our government jockeying for control. It is unprecedented in the modern day. Historically it is the Executive and Legislative Branches that engage in fierce and costly competitions for the power to do something to the citizenry, albeit directly to us, or with our money.</p>
<p>But now in 2025, we see the once-thought highly respectful Judicial Branch entering the ring. A true power struggle of epic proportions. Who is right, and who is overstepping? A verifiable crisis indeed.</p>
<p>The cause is clear. So is the answer.</p>
<p>The cause? Well, we have a new administration in the White House, one that was resoundingly put there by an unquestionable majority of Americans. The 47th President won not just the Electoral College, but he won the popular vote by millions of votes. It was a modern-day landslide. However, We The People did not stop there.</p>
<p>This past November, we didn’t simply elect a new leader; we also gave him all the tools he would need to get the job done. Namely, we gave him a Republican House of Representatives <em>and</em> a Republican Senate. We Americans, tired of the lawlessness of the Biden years, (where the absurdities came at such a rapid rate that your head would spin, and then explode, from the shock of their backward policies), decided to clean house at a level not seen in recent memory.</p>
<p>We cast aside the radical, anti-American policies of Biden and his handlers, and we gave President Trump the White House for a second time. This time, however, that privilege was coupled with a mandate, and we cleared the path for him to execute it. An all-Republican-Congress will do his bidding, which is our bidding. Gone are the days of outlandish insanity (like appointing a Supreme Court Justice who has no idea how to define a woman because well, as she explained, she’s not a biologist). No more! Logic, law, and order are full steam ahead. Nothing can stop us now…</p>

										<content:encoded><![CDATA[<p>We are living in a point in history where so many, if not all, of the foundational pillars of our society are being questioned. In some cases, those pillars are almost wholly being cast aside. Once the cornerstones of our American backbone, we are finding ourselves doubting it all as we ask ourselves and one another… <em><mark class="beyondwords-highlight bwp id-8ec920b0-d0e6-4ff5-852c-1acecb0eb869">Can the government truly be </mark></em><mark class="beyondwords-highlight bwp id-8ec920b0-d0e6-4ff5-852c-1acecb0eb869">that</mark><em><mark class="beyondwords-highlight bwp id-8ec920b0-d0e6-4ff5-852c-1acecb0eb869"> corrupt? Are the courts actually compromised? Are major media outlets really just mouthpieces for propaganda? Is modern medicine a sham?</mark></em></p>
<p data-beyondwords-marker="7d44d127-cca6-4967-bef5-af074344fd9c">It is difficult for people to question what they have known all their life to be something that is “good” or “honest” or “reliable.” Why would you doubt the things that everyone around you (including your trusted friends and beloved family members) are telling you are true, and pure, and good?  <em>Of course the government is there to protect us. Of course the legal system is designed to uphold our righteous laws and defend liberty. Of course the newscaster on the TV is telling us the truth. Of course the drugs our doctors prescribe to us are there to help us get well. </em></p>
<p data-beyondwords-marker="f779ea3d-3179-4eba-8970-8f010d733b5e">As hard as it is to question societal norms, it is even more difficult to do something about it. Indian author Arundhati Roy has said:</p>
<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow" data-beyondwords-marker="692f77bf-4973-4947-b76a-9783a7b2fbea">
<p data-beyondwords-marker="6efff3f4-7fad-44eb-9acd-8df38f873a87"><em>“The trouble is that once you see it, you can’t unsee it. And once you’ve seen it, keeping quiet, saying nothing, becomes as political an act as speaking out. There’s no innocence. Either way, you’re accountable.”</em></p>
</blockquote>
<p data-beyondwords-marker="9277b1ac-174b-41db-931c-3c667eb2e4c4">In questioning traditional, stalwart institutions, we find ourselves standing on the precipice of a rabbit hole so large and deep, it is better likened to a meteoric crater than simply a hole. There are so many craters all around us now – the government crater, the legal crater, the medical crater, the media crater, and so on. These craters are appearing one after the next, in parallel formation, and like dominos, if one begins to fall, the chain reaction of full scale collapse is undeniable.</p>
<p data-beyondwords-marker="8dcc1252-6138-4b63-8c01-e17524cfc752">Let us, for a moment here, peer over the ridge of one of these craters as we ask ourselves…</p>

<p data-beyondwords-marker="cda89196-ddbd-4b7b-b375-8f8f4e72e16d">Let’s first look at the learned, societal norm…When most people hear the word “medicine,” their mind immediately forms a positive opinion and thinks, “<em>This will help me feel better and get well</em>.” Like Pavlov’s dog, we have been trained to correlate medicine with the thing that cures your sickness when you are ailing. You have a malady, you go to the doctor, they give you medicine, and it will fix the malady from which you are suffering and restore your health. Right? Ehhhh, well, ummmm, not exactly. Sadly, in today’s world, “health” has become synonymous with “medicine,” and medicine has become an industry – and not just any industry. It is a behemoth!</p>
<p data-beyondwords-marker="187345c0-ecf1-4625-9958-bc466ce0eff2">Did you know that the largest lobby we have in the United States is the pharmaceutical industry? It is the largest, by a long shot, as it solidly towers over all of the others. Let me share <a href="https://www.opensecrets.org/federal-lobbying/industries?cycle=2024">some numbers</a> with you. Pharma spends approximately $380,000,000 (three hundred eighty million) every year lobbying Congress. To give you some perspective, the second largest lobby industry in our nation is the electronics manufacturing industry, and it spends about $250,000,000 a year lobbying Congress. The third largest is the insurance industry which spends about $150,000,000 a year lobbying Congress. All the other industries that lobby simply pale in comparison. These statistics alone reveal so much.</p>
<p class="" data-beyondwords-marker="43a6e202-f878-48b7-bb72-edf9cf64fa35">And so, <em>health</em> (which used to mean how well your body functions in relation to other natural interactions and happenings like sufficient sunlight, fresh water intake, clean air, sufficient sleep, what you eat, and how much you exercise) now means <em>medicine</em>. When you go to the doctor, do they ask you how much water you drink and the amount of sunlight you absorb every day, or do they ask you what pills you are popping? Whether because of the C-19 debacle, or perhaps through osmosis, the medical industry has recently garnered a reputation of being untrustworthy and ineffective – two adjectives that can surely take down the entire industry once they hit a critical breaking point in numbers of non-believers.</p>
<p data-beyondwords-marker="b8037cdd-9faa-48b1-9782-10033ce85dcb">Let’s look at someone’s real-life example as a case study. Let’s look at mine. Quick caveat that I am of course not offering medical advice of any kind, but instead simply sharing my recent experiences.</p>

										<content:encoded><![CDATA[<p>Imagine this for a moment…You inherit a family member’s house after they pass, and instead of moving in, you decide to sell it. Of course, that takes some time, as you must first get all of the legal requirements dealt with – the will must be probated, the paperwork must be properly executed and in good order, then you need to find a realtor you like, maybe repair a thing or two before placing the house on the market, and so on. After several weeks (or possibly months) of working to get all of this accomplished, you go by the house to start removing unwanted furniture, clothing, etc., but when you walk up to the front door and try to put the key into the lock, your key doesn’t work.</p>
<p class="">You say to yourself, <em>I must have tried the wrong key. Let me try another. </em>But it wasn’t the wrong key. No. Instead, you realize that someone changed the lock on the door! You cannot get into your house! So you knock on the door, and to your shock, the door opens and you are standing face to face with a complete stranger. You demand they leave, of course, but astonishingly, they refuse. They say it’s <em>their </em>house and has been for weeks now, even though they never asked your permission, or signed a lease, or paid a penny to live there.</p>
<p>The nightmare continues, when you call the police to report a trespassing, only to have the police tell you that they are powerless to do anything, since the “trespassers” have been there for more than 30 days. Thanks to New York State law, those occupants of your house are not trespassers, nor are they breaking the law. Nope. Just the opposite. They are now your <em>tenants</em>, and they possess all of the amazing “rights” that the lawmakers in Albany have bestowed upon tenants, to the severe detriment of landlords.</p>
<p>So now you are a landlord, even though you never met the people who are living in your property, you never got to run a credit check on them to see if they can afford to pay the rent, you never got to do a criminal background check to see if they have an undesirable history which could open you up to liability, etc. As a landlord, in order to get these squatters out of your house, you must now hire an attorney and go through the very lengthy and quite costly expense to sue them. Evictions take months upon months, not days or weeks. As a landlord, you are obligated to maintain the property until the eviction is complete. So you must continue to pay the property taxes, the mortgage, the insurance, upkeep on the grounds, heat working, water flowing, etc. In other words, you must pay for these total strangers to live for free. Indefinitely!</p>
<p>This nightmare situation is known as <em>squatting</em>, and not only is it real, it’s becoming extremely common place. I was recently on NTD News to discuss this criminal phenomenon. <p>New York state is one of the worst states in the nation to own a gun. Thank goodness for the Second<br />
Amendment and for the Supremacy Clause in our federal Constitution, which (in its most basic description) puts federal law above state law (for the most part). If it wasn’t for those two staples in our federal Constitution, New York state would undoubtedly wipe gun ownership off the state map!<br />
How do I know this? Just look at the overwhelming evidence. To start, did you know that the word<br />
gun doesn’t even appear in our state Constitution? Not once. Nor does the word arms. The only remote (and highly tenuous) reference to the right to bear arms in our state Constitution is Article XII, which establishes an organized militia. The entire article is two, rather anorexic, sentences that<br />
read:</p>
<p><em>Section 1. The defense and protection of the state and of the United States is an obligation of all persons within the state. The legislature shall provide for the discharge of this obligation and for </em><br />
<em>the maintenance and regulation of an organized militia.</em></p>
<p>This is a far cry from codifying the Second Amendment into our state Constitution. Regardless, thanks to our federal Constitution, no matter how begrudgingly, the radical politicians who control our New York state Legislature must allow gun ownership. However, they have a long history of pushing the limits with government overreach in this arena by making it extremely difficult to own a<br />
gun in this state.</p>

<p class="has-drop-cap">There is much buzz in the media about President Trump’s new pick for Surgeon General, Dr. Casey Means. She sprang into the spotlight, and the hot seat, just a few days ago when President Trump withdrew from consideration his first nominee, Dr. Janette Nesheiwat. Apparently Nesheiwat publicly <a href="https://www.cbsnews.com/news/janette-nesheiwat-surgeon-general-nomination-withdrawn-white-house/">misrepresented</a> her medical schooling, and was also receiving strong criticism for supporting the Covid-19 jab during the pandemic. As such, they cancelled her confirmation hearing that was supposed to take place last Thursday, and instead President Trump appointed RFK, Jr. ally, Dr. Casey Means.</p>
<p>The sharks are circling, questions and criticisms are swarming pertaining to Means, everyone searching for some dirt or juicy storyline about this doctor. Honestly, that’s all fine and good, and they can all do their familiar tap dance if they like. But my question isn’t “<em>Who is Dr. Casey Means?</em>” or “<em>Is she qualified for the position?</em>” No, my question is much more cynical – esoteric even. My question strikes at the very heart of the cnidarian medusa head. I don’t want to know about the <em>person</em> who might possibly fill the seat. Instead I question the <em>seat</em> itself. I ask, <em>“Do we even need a Surgeon General at all?”</em></p>
<p>The position of Surgeon General is not so much a functional position as much as it is a symbolic post. After all, the Surgeon General isn’t out there treating patients and performing surgeries across the country as the title may insinuate. No. Instead, the position symbolizes a very unhealthy and unnatural relationship between government and citizen. It is the foundation of the dangerous psyop that conditions the minds of Americans to believe that the government should tell you what to do, how to do it, when you can do it, and why. It is the poison seed of totalitarian control that is so cleverly disguised that scarcely a soul questions it.</p>
<p>Surgeons General warn us not to smoke tobacco, nor to consume alcohol when pregnant, don’t have sex without a condom, and so on. Seems harmless enough. I mean, they’re trying to <em>help</em> us, right? If that is what you are thinking, then you are missing the mark. You need to take a step back and look at this through a different lens. You need to see the forest for the trees.</p>

<p>Though somewhat hard to imagine in 2025 with COVID-mania in our rearview mirrors, the truth of the matter is that the highest court in New York, the Court of Appeals, has unbelievably opened the door for <em>quarantine camps</em> to become a reality. I have fought the governor in court for the past three years to prevent quarantine camps from taking hold, and I was successful to some extent (the Department of Health cannot currently throw you into a quarantine facility), but ultimately the State has been given the green light by our courts. A unimaginable travesty of justice!</p>
<p>When COVID-19 hit back in March of 2020, the NYS Legislature (illegally, I might add) gave then-governor Andrew Cuomo the power to make “directives” (read “laws”). Continuing with the illegal trend, Cuomo then passed that power on to the Department of Health (DoH). The DoH then created the “<em>Isolation and Quarantine Procedures</em>” regulation, which the public rightly dubbed the “Quarantine Camp” reg. The regulation was <em>not</em> a law, as it did not come from the NYS Legislature. Instead, it was a reg written by unelected bureaucrats who answer to nobody but the bureaucrat or politician who hired them. The reg actually conflicted with our long-standing (full-of-due-process-protections) quarantine<em> law</em> that was passed by the Legislature in 1953. Regs cannot conflict with laws! That is a violent breach of Separation of Powers, which is the cornerstone of our free society.</p>
<p>Details on the atrocities of this reg can be found in a <a href="http://www.americanthinker.com/articles/2022/06/stopping_quarantine_camps_in_new_york_state.html">previous article</a>. But in sum, the Quarantine Camp regulation gave the unelecteds in the DoH the power to pick and choose which New Yorkers they could lock up or lock down, indefinitely, and at any location of their choosing &#8212; you had no say. They could have locked you down in your home, or they could have removed you from your home, with the force of police, and stuck you in a quarantine facility for days, weeks, months, etc. No notice was required, so they could have knocked on your door during family dinner and removed you from your home without any warning whatsoever. You did not have the right to an attorney until <em>after</em> you were locked up or locked down. There was no age restriction, so they could have done this to you, or your child, or grandchild, or elderly parent… And the most shocking part of this reg was that they did <em>not</em> even have to prove you were sick! Guilty until proven innocent &#8212; the very antithesis of the principle upon which our nation’s judicial system is based.</p>

<p class="has-drop-cap">What is your first reaction to the title of this article? Shock? Disbelief? Skepticism? I’m sure many of you are thinking, <em>But it’s 2025…We are 5 years out from the insanity of Covid-mania. And we have a new Administration in the White House…How on earth are you talking about “quarantine camps” now? </em></p>
<p>Well folks, the truth of the matter is that my quarantine camp lawsuit which I first started three long years ago has just reached its conclusion. The highest court in New York State, the Court of Appeals, issued its final ruling in the case…This panel of seven appointed judges is <em>refusing</em> to hear the case! That means the grossly erroneous intermediate appellate court’s ruling will stand, which in turn means that Governor Hochul and her dystopian New York State Department of Health are free to reissue their heinous quarantine camp regulation at will. Buckle up, New York!</p>
<p>This is a true travesty, not only for 19 million New Yorkers, but for <em>all</em> Americans. “<em>How can that be?”</em> you might ask. A little-known fact is that our federal government issued a quarantine camp regulation very similar to New York’s, and as far as I can tell, it was modeled on (and updated to its latest form after) New York’s! The only reporting I could find on this unbelievable fact is by Brownstone Institute founder and president, Jeffrey Tucker. His article, <a href="https://brownstone.org/articles/the-cdc-planned-quarantine-camps-nationwide/">The CDC Planned Quarantine Camps Nationwide</a>, tells the tale. Of course, the feds didn’t call it a “Quarantine Camp” regulation. (Nor did New York’s DOH). They always wrap the biggest lies up in candy, don’t they? The feds called it “the shielding approach,” and you can read more details about it on their website <a href="https://web.archive.org/web/20200728203549/https://www.cdc.gov/coronavirus/2019-ncov/global-covid-19/shielding-approach-humanitarian.html">here</a>.</p>
<p>Now that New York’s regulation is being left open for re-enactment, there’s no chance of using our onerous and lengthy legal battle as persuading precedence in a fight against the federal reg. In very simple terms and generally speaking, state courts do not have a binding effect on federal courts. Nor do federal courts have a binding effect on state courts, except for the United States Supreme Court.</p>
<p>That being said, there is such a thing called persuasive precedence. It’s when a court that is not subject to mandatory precedence considers the decision of a non-binding court even though it doesn’t have to. It’s akin to professional courtesy, but it also typically follows logic. For example, if the highest state court in Pennsylvania ruled that<a href="https://www.foxnews.com/politics/pennsylvanias-high-court-strikes-down-school-mask-mandate-amid-gop-backed-lawsuit"> forced masking during Covid is illegal</a>, it would be persuasive precedence for a state court in another state to rule accordingly. Now, this does not always happen, but it does happen often enough that it is a common stance in law.</p>
<p>Applying to the case at hand, after I’ve just gone through three years of costly and time-consuming litigation on New York State’s quarantine camp regulation, if I had a decision from our State’s highest court that upheld my trial court win, then that decision could have been used as persuasive precedence in a case against a different state’s (or the federal government’s) quarantine camp regulation. Something that I was considering at one point. However, that’s not how the game unfolded.</p>
<p>I explain…</p>
<p>Let’s begin with the reg itself. For those of you unfamiliar with my epic, David v. Goliath battle against New York State’s quest for ultimate control, you need to first understand what their quarantine camp regulation empowered the State to do. This excerpt from an article I wrote for <a href="https://www.americanthinker.com/articles/2022/06/stopping_quarantine_camps_in_new_york_state.html">the American Thinker</a> back in June 2022 (before I won the initial lawsuit), paints a clear picture of the stunning atrocity that was the NYS “<em>Isolation and Quarantine Procedures</em>” regulation…</p>

<h2 id="h-the-truth-behind-their-lies" class="wp-block-heading">The Truth Behind Their Lies</h2>
<p>For anyone who knows me well, you know that it takes tremendous circumstances for me to call someone a <em>liar.</em> I loathe when people twist truth or hide behind smoke screens. In fact, it’s one of the driving forces that stokes the fire in my belly and keeps me fighting on the front lines to defend our rights, our freedoms, our Constitution, against power-hungry politicians and their corrupt government bureaucrat cohorts. True enough. However, I rarely use the word “liar” to define them and their ilk. I would normally say they are deceitful or sly or untruthful, etc. But, now they have crossed the line, and I absolutely refuse to allow this abhorrent fraud to sway voters. Gloves are off. Game on!</p>
<p>If you’ve been following my work the past several months, you’ll know I have been a very vocal opponent of a proposed amendment to our NYS Constitution called “Proposal Number One” (or “Prop 1” for short). The cowardly politicians that put this proposal on our ballots for us to vote on are slyly calling it the <em>“Equal Rights Amendment,”</em> but in reality, it will dilute and/or abolish many of your rights. It is the <a href="https://attorneycox.substack.com/p/a-trojan-horse-of-epic-proportions" target="_blank" rel="noreferrer noopener">greatest Trojan Horse </a>of our time. Why are they cowards? Because they don’t have the courage to tell you what Prop 1 is really about. So I will…</p>
<p>If Prop One passes, it will unleash a massive tidalwave of chaos upon our citizenry, upon normalcy, and upon all that we hold dear in our society. In other words, life as you know it will no longer be the norm. If Prop One passes it can lead to:</p>
<ul class="wp-block-list">
<li>the weakening of your parental rights and give the government control of your children (which is already happening in schools across the State thanks to this outrageous and unconstitutional <a href="https://www.nysed.gov/sites/default/files/programs/student-support-services/creating-a-safe-supportive-and-affirming-school-environment-for-transgender-and-gender-expansive-students.pdf" target="_blank" rel="noreferrer noopener">“guidance”</a> the Department of Education issued last year);</li>
<li>making New York a permanent sanctuary state where illegal immigrants (including criminals) can’t be deported;</li>
<li>opening the door for non-citizens, including illegal immigrants, to claim a constitutional right to receive the same tax-payer funded benefits that citizens receive (like government assistance, medicare, social security, disability compensation, subsidized health care, etc.) and could eventually include the right to vote (see my X post on that <a href="https://x.com/Attorney_Cox/status/1840057059573711197" target="_blank" rel="noreferrer noopener">HERE</a>);</li>
</ul>

<p class="has-drop-cap">I was interviewed last week by the <a href="https://nypost.com/2024/09/30/us-news/ny-ballot-measure-could-allow-illegal-migrants-to-vote-critics-say/">New York Post</a> about an extremely important issue…a proposed amendment to our Constitution here in New York which is called “Proposal Number One” (aka “Prop One”). Though it is a statewide, New York ballot initiative (meaning it will be on the ballot for every New Yorker to vote on across the State), its consequences (if it passes) will undoubtedly ricochet across the nation. In other words, if we don’t stop it here, now, then it’s going to pass, and then it will come to your state sooner or later.</p>
<p>How am I sure of that? Well, firstly because historically speaking, radical policies that begin in New York tend to have a ripple effect once they take hold here. And secondly, because this proposed amendment is a Trojan Horse of epic proportions, meaning it’s not at all what the left is saying it is. As they so often do, they dress it up in word salad style so that you don’t know what it actually means. The Archdiocese in New York has come out against this proposed amendment, and the <a href="https://www.nyscatholic.org/posts/proposal-1-wolf-sheeps-clothing">Catholic Conference </a>including Cardinal Dolan, calls it a wolf in sheep’s clothing.</p>

<p>The radical politicians who thought this up are the same who gave us radical, failed policies such as No-Cash-Bail, Clean Slate, Raise the Age, and Congestion Pricing. They are selling Prop One as an “<em>Equal Rights Amendment</em>” that will protect <em>abortion</em> in New York, though none of those words actually appear on the ballot. Nonetheless, when you read it, it sounds “fair” – I mean who doesn’t want equal treatment for all? But in reality, if it passes, it will not give anyone any new “equal rights” since all the categories in there are already protected under our NYS laws. However, what it will do is weaken your rights, and further empower the radical politicians who run our government. Here’s how…</p>
<p>Let’s start with what language you’ll actually see <a href="https://elections.ny.gov/2024-statewide-ballot-proposal">on your ballot</a> (either at the bottom or on the back of the ballot). This is the introductory language:</p>
<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><em><strong>Amendment to Protect Against Unequal Treatment</strong></em></p>
<p><em>This proposal would protect against unequal treatment based on ethnicity, national origin, age, disability, and sex, including sexual orientation, gender identity and pregnancy. It also protects against unequal treatment based on reproductive healthcare and autonomy.</em></p>
<p><em>A “YES” vote puts these protections in the New York State Constitution.</em></p>
<p><em>A “NO” vote leaves these protections out of the State Constitution.</em></p></blockquote>
<p>Then after that, you will see the actual proposed change to our Constitution which will read as follows:</p>
<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>Concurrent Resolution of the Senate and Assembly<strong> </strong>proposing an amendment to section 11 of article 1 of the constitution, in relation to equal protection</p>
<p>Section 1. Resolved (if the Assembly concur), That section 11 of article 1 of the constitution be amended to read as follows:</p>
<p>§ 11. <em><strong>a. </strong></em>No person shall be denied the equal protection of the laws of this state or any subdivision thereof. No person shall, because of race, color, <em><strong>ethnicity, national origin, age, disability,</strong></em> creed [<strong>or</strong>]<strong>,</strong> religion, <em><strong>or sex, including sexual orientation, gender identity, gender</strong> <strong>expression, pregnancy, pregnancy outcomes, and reproductive healthcare</strong> <strong>and autonomy, </strong></em>be subjected to any discrimination in [<strong>his or her</strong>] <em><strong>their </strong></em>civil rights by any other person or by any firm, corporation, or institution, or by the state or any agency or subdivision of the state<em><strong>, pursuant to law</strong>.</em></p>
<p><em><strong>b. Nothing in this section shall invalidate or prevent the adoption of any law, regulation, program, or practice that is designed to prevent or dismantle discrimination on the basis of a characteristic listed in this section, nor shall any characteristic listed in this section be interpreted to interfere with, limit, or deny the civil rights of any person based upon any other characteristic identified in this section.</strong></em></p>
<p>§  2. Resolved (if the Assembly concur), That the foregoing amendment be submitted to the people for approval at the general election to be held in the year 2024 in accordance with the provisions of the election law.</p>
<p>Explanation – Matter in underscored is new; matter in brackets [ ] is old law to be omitted.</p></blockquote>
<p>Sounds warm and fuzzy, doesn’t it?</p>
<p>It’s not!</p>
<p>If Prop One passes, it will unleash a massive tidal wave of chaos upon our citizenry, our norms, and what we hold dear in our society. In other words, life as you know it will no longer be the norm. If Prop One passes it can lead to:</p>

<li>abolition of single-sex spaces such as high schools, colleges, clubs, organizations, etc.;</li>
<li>the chilling of free speech (see my X post on that <a href="https://x.com/Attorney_Cox/status/1842694669928431950">HERE</a>);</li>
<li>the legalization of reverse discrimination (see <em>paragraph b</em> of Prop One noted above).</li>
</ul>

<p class="has-drop-cap">One of my colleagues, a medical doctor, that I often “tour” with on what many refer to as the “freedom” circuit, texted me a meme a while ago that I just love. Well, to be honest, I actually despise it because of what it symbolizes, which is the tremendous struggles we’ve endured the past four and a half years to get our voices heard by the masses. But part of me likes the meme because it completely embodies what life was like in 2020 for those of us who were speaking out almost from the moment the government said, <em>“Lockdown! Just for 2 weeks to flatten the curve.”</em></p>
<p>Whilst my doctor (MD and PhD), academic, and economist colleagues were trying to warn people about the negative medical, mental, and economic consequences of locking down perfectly healthy people throughout the world for months on end, personally, I was shouting from the rooftops peering through my legal lens saying, <em>“The government cannot do this, folks! Wake up!” </em>But nobody was listening to me back then. Nobody was listening to any of us. And we didn’t know one another at that point. Nor did we know how to find one another, or even if each other existed at all! The censorship was so thick, you could cut it with a knife. (I’m not exactly sure that thickness has lessened any these past few years. It’s disputable, indeed, but that’s a story for another day).</p>
<p>Once my bold, vocal colleagues and I finally found each other through the fog of censorship, we shared our eerily similar stories about how mainstream media was boycotting us, our work and our “against the narrative” public speeches, and how Big Tech was silencing each and every one of us online. Facebook was sending us “warnings” for posting “misinformation” (whatever that means, because of course I challenged them constantly and asked who they thought they were to determine what was truth and what wasn’t – they responded to none of my challenges, since they clearly had no leg to stand on).</p>
<p>Then there was their blatantly obvious shadowbanning us to the point where I’d post something and they’d only let 14 people see it. In the early days, I had a YouTube channel, but they tore down my videos within an hour or two of posting, and they threw me in YouTube jail so many times, I lost count. Some of my colleagues had tens of thousands of YouTube or Twitter followers, and then poof! One day they lost them all because the overlords cancelled their accounts.</p>
<p>Despite the ever-thickening wall of censorship, we continued speaking out – trying to get the masses to hear logic. <em>“No! The government cannot lock you down for months on end when you are perfectly healthy. It defies our laws, our Constitution, and basic logic.”</em> Yet, we all were facing resistance that was truly unbelievable. Still do today, to a large extent. (Note, I have only about 6,000 followers on Twitter). I personally kept hearing about how, “Jacobson allows the government to control us when there is a health emergency.” I heard a lot of <em>Jacobson this</em> and <em>Jacobson that</em>. My response? <em>Put Jacobson to rest, people. It does not give the government (Trump’s, Biden’s or anyone else’s) the power to lock us down indefinitely. </em></p>
<p>I stand by that still today. For anyone unaware of what “Jacobson” is, it was a 1905 US Supreme Court case called <em><a href="https://caselaw.findlaw.com/us-supreme-court/197/11.html">Jacobson v. Massachusetts</a></em>, and it has been wildly twisted and distorted beyond belief during the years of the Covid pandemic. In almost all of my speeches over these past few years, I have tried to emphasize the fact that the Constitution does not have an emergency exemption. In other words, the Constitution is not invalid during times of emergency. In fact, it is during times of emergency that we need our Constitution most urgently, as that is the time when government will most likely overstep its bounds and violate our rights and freedoms (in the name of “public safety” of course).</p>
<p>If you think about it, it was during a time of great turmoil that our Constitution was first written, and it was specifically composed to keep <strong>the government</strong> in check – <strong>not</strong> to keep We The People in check!
